WIN $5,000 with Truelocal.com.au – TERMS & CONDITIONS

  1. Information on how to enter form part of these conditions of entry. Participation in this competition constitutes acceptance of these terms & conditions of entry.
  2. Entry is open to all permanent residents of Australia aged 18 years or over. Employees, directors and management of the Promoter or of the agencies or companies associated with the competition and the immediate families of these persons are ineligible to enter.
  3. Competition commences on Thursday 30th July 2009 at 10.31am AEDT and closes Thursday 15th July 2010 at 10.30am AEDT (Promotional Period).
  4. To enter, Eligible Entrants must, during the Promotional Period, register a legitimate business on truelocal.com.au, and/or upload content to their business listing and/or purchase a priority listing on truelocal.com.au during the Promotional Period. A legitimate refers to a business that has a registered ABN number.
  5. Entry is via online at www.truelocal.com.au/win5k; all entries must be submitted online and received by the Promoter during the Promotional Period.
  6. Once a business is registered and their account has been activated they are permitted to upload content via the online ‘My Business Manager’.
  7. All content is hosted with Truelocal and can be managed by the business owner. By entering content all entrants:
    1. Only post or upload video clips, photos, images, logos or music (Content) they own the necessary lawful rights to, including but not limited to copyright, trademark, consents, permissions or other proprietary rights;
    2. Grant truelocal a non-exclusive, royalty-free, perpetual licence to publish the Content, regardless of the format it is submitted in, including but not limited to any text, photographs, graphics, video or audio;
    3. Take sole responsibility for any Content they submit and any consequences resulting from posting or publish the Content, including but not limited to legal liability;
    4. Indemnify truelocal against any and all claims made against truelocal relating to the Content , including but not limited to legal fees, expenses and damages that may be incurred by truelocal;
    5. Obtain written consent from each person depicted in the Content, to use their image, photograph or license; and
    6. Undertake to the Promoter that their entry is not, and its use by the Promoter will not be, in breach of any third party intellectual property rights.
  8. All businesses that enter during the promotional period are entered into the major draw. Content received during the Promotional Period will be individually moderated by representatives of the Promoter to ensure content posted is not illegal, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, indecent, libellous, hateful, obscene, or otherwise injurious to third parties or otherwise objectionable.
  9. Draw 1 – Each entrant must register their business, and/or upload content and/or purchase advertising on truelocal.com.au. Each entry is worth different number of points. These are:
    1. All entrants who register their business between 30/07/09 and 28/01/10 receive one entry in the draw.
    2. All entrants who upload content between 30/07/09 and 28/01/10 receive five entries in the draw.
    3. All entrants who sign up for a priority or premium listing between 30/07/09 and 28/01/10 receive ten entries in the draw.
    4. All entrants who sign up for a ‘top of list’ listing between 30/07/09 and 28/01/10 receive ten entries in the draw.
    Draw 2 – Each entrant must register their business, and/or upload content and/or purchase advertising on truelocal.com.au. Each entry is worth different number of points. These are:
    1. All entrants who register their business between 29/01/10 and 15/07/10 receive one entry in the draw.
    2. All entrants who upload content between 29/01/10 and 15/07/10 receive five entries in the draw.
    3. All entrants who sign up for a priority or premium listing between 29/01/10 and 15/07/10 receive ten entries in the draw.
    4. All entrants who sign up for a ‘top of list’ listing between 29/01/10 and 15/07/10 receive ten entries in the draw.

  10. The first eligible entry drawn from all entries received will receive $5000. Total prizepool is valued at $10,000. The value of the prize is accurate as at the commencement of the Promotional Period and the Promoter will not be responsible for any variation in the value of the prize after that date.
  11. The winners will be drawn by random automated selection and is final; no correspondence will be entered into. The prizes are not exchangeable or transferable.
  12. The draw will take place at MDSA, 15 Grosvenor Street, Neutral Bay, NSW, 2089. There will be two draws.
    Draw 1 – All eligible entrants between 30/07/09 and 28/01/10 drawn on Thursday 11th February 2010 at 2.00pm.
    Draw 2 – All eligible entrants between 29/01/10 and 15/07/10 will be drawn on Thursday 22nd July 2010 at 2.00pm.
  13. The winners will be notified by email and telephone and their name and state/territory of residence will be published within The Australian Newspaper on:
    Draw 1 – Thursday 18th February 2010.
    Draw 2 - Thursday 29th July 2010,
    The winner’s name will also be placed on www.truelocal.com.au/win5k.
  14. Prizes are not transferable or exchangeable.
  15. The Promoter may require entrants to show that they are an Eligible Entrant. Validation may (in the Promoter's sole discretion) include the entrant providing the Promoter with:
    1. Proof as legitimate business owner; and
    2. Proof of business address (identification considered suitable for verification is at the discretion of the Promoter).
  16. The Promoter accepts no responsibility for any problems or technical malfunction of any communication network or for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence arising from any error, omission, alteration, deletion, theft, destruction, transmission interruption and communications failure or otherwise. The Promoter has no control over communication networks or lines and accepts no responsibility for any problems associated with them, whether due to network traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any costs incurred, responses received or any other consequences of user error. Any costs associated with accessing the truelocal.com.au website is the Eligible Entrant's responsibility and is dependent on the Internet service provider used.
  17. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web sites, or any combination thereof, including injury or damage to participants or any other person's computer related to or resulting from participation in or down-loading any materials in the competition.
  18. Prizes must be claimed by Friday 15/10/2010. If a prize remains unclaimed by that date a second chance draw will take place on Friday 29/10/2010 at the same time and place as the original draw, subject to any law or directions from a regulatory authority. The winner/s names will be published in The Australian newspaper on Friday 05/11/2010.
  19. The Promoter and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with this competition, or using any prize except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  20. The Promoter reserves the right, in its sole discretion, to disqualify all entries from any person, and prohibit that person's further participation in this competition, who tampers with, or benefits from any tampering with, the entry process or the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any person.
  21. All entries become the property of the Promoter. All entries will be entered into a database and the Promoter may use the entrants’ names, addresses, telephone numbers and the winners’ name and address and photographs for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant.
  22. If for any reason this promotion is not capable of running as planned, including unauthorised intervention, fraud, or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in it’s sole discretion to disqualify any individual who tampers with the entry process.
  23. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to state legislation.
